Two different documents
A life policy versus a prepaid funeral contract
A prepaid funeral benefits contract is an agreement for specified future funeral goods or services. It is legally distinct from a life policy — although it can be funded through an approved trust or through an insurance policy or annuity, which is exactly why the two get confused.
Which regulator you are dealing with depends on which document you hold. The Texas Department of Banking regulates the prepaid contract and its permit holder; the Texas Department of Insurance regulates a policy or annuity used to fund it; funeral establishments and directors answer to the Texas Funeral Service Commission, a third body again.
The consequence people discover late: if the arrangement is insurance-funded, cancelling the prepaid contract does not automatically cancel the funding policy. Unwinding both can mean cancelling both in writing, and the cash surrender value can be less than the payments made.
